Terms of Service

1. Agreement and operator

These Terms govern bisarolosolution at bisarolo.com, operated by WILLAN PRODUCTIONS LTD ("we", "us"). By creating an account or using the service, you agree to these Terms. If acting for an organisation, you confirm your authority to bind it.

2. Service scope

The workspace supports recording and organising advertising campaign plans. Creating a draft, pausing a plan or archiving a record does not launch, pause or cancel advertising with any media provider. No live media connection or advertising inventory access is included in this workspace. Any additional service requires a separate written agreement specifying its scope.

3. Accounts and acceptable use

Provide accurate account details, protect your credentials and notify us of suspected unauthorised access. Do not bypass access controls, interfere with the service, access another customer's data or submit unlawful material. Our Advertising Policy applies to content and campaign plans.

4. Customer material and responsibility

You retain your rights in submitted material and grant us permission to host and process it only as needed to provide the service. You are responsible for the rights, accuracy and legality of creative assets, landing pages, advertising claims, targeting decisions, audience data and intended advertising locations. You must obtain necessary permissions and consents and comply with applicable advertising and data protection law. You must independently verify records and reports before relying on them.

5. Fees and cancellation

Any paid service, price, currency, taxes, renewal terms and scope must be stated in an agreed order. A free account or campaign draft does not itself establish a paid media order. See our Refunds & Cancellation Policy. No subscription or renewal is created merely by registering.

6. Intellectual property and confidentiality

We and our licensors retain rights in the service. These Terms grant access for your permitted use, not ownership of our software or branding. Each party must use reasonable care to protect the other's confidential information and use it only to perform the agreement, subject to lawful disclosure obligations.

7. Data protection

Our Privacy Policy explains how we handle account and contact information. Each party must comply with applicable data protection law. If a proposed additional service requires us to process personal data on your behalf, appropriate processing terms must be agreed before that processing starts.

8. Availability, third parties and results

We do not warrant uninterrupted or error-free availability, or that the service or any campaign will achieve particular impressions, clicks, conversions or revenue. No advertising result is guaranteed. Third-party websites and any separately arranged third-party services remain subject to their own terms. We are not responsible, to the extent permitted by law, for acts, omissions, content or availability of publishers, media sources or other third parties outside our reasonable control. This does not remove responsibility for our own legal obligations.

9. Suspension and termination

We may refuse, restrict, pause or remove content or suspend access for maintenance, security, legal or operational reasons, including suspected misuse or breach of these Terms. Where practical, we will explain the reason and permit a review request through support@bisarolo.com. You may request account closure through the same address. Data handling after closure remains subject to applicable law and our Privacy Policy.

10. Liability and business claims

To the extent permitted by law, we exclude liability to business customers for indirect or consequential losses, including loss of profits and business opportunities. Any aggregate liability cap must be expressly agreed in the applicable written service agreement and must be lawful; no numerical cap is imposed by these Terms. Business customers are responsible for third-party claims arising from their unlawful advertising material, targeting instructions, audience data or breach of rights, to the extent caused by their conduct and permitted by law.

Nothing in these Terms excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded or limited under the laws of England and Wales. Nothing restricts statutory consumer rights, including under the Consumer Rights Act 2015 where applicable, or our obligations and your rights under applicable data protection law. These protections apply to all disclaimers, exclusions, indemnities and limitations.

11. Events beyond reasonable control

Subject to the protections above, neither party is liable for failures or delays caused by events beyond its reasonable control, such as natural disasters, public infrastructure outages or lawful government restrictions. The affected party should take reasonable steps to reduce the impact. This does not remove non-excludable legal duties.

12. Governing law and changes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, subject to mandatory consumer protections and rights to bring proceedings elsewhere. We may update these Terms and will give appropriate notice of material changes. Mandatory legal rights remain unaffected.
